Once the trademark application is prepared and submitted to the United States Patent and Trademark Office (USPTO), it generally takes anywhere from 2-4 months until it is assigned to an examining trademark attorney who will review the application. If anything else is needed, the examining trademark attorney will issue an office action with the information. Once all information is received, reviewed and approved for publication, the mark is published in the Official Gazette. After the mark is published, any party who believes it may be damaged by registration has 30 days to file an opposition to registration. If no opposition is filed, the application enters the next stage of the registration process and the USPTO will typically register the mark and issue a certificate in about 12 weeks. Although the trademarking process is a lengthy one, protecting your intellectual property is important to the value of your company and will be worth it.
